Heller and McDonald v. Chicago rulings, the Tenth Circuit Court of Appeals held today that the Second Amendment does not protect gun rights outside of one’s home. The case, Bonidy v. United States Postal Service, challenged 39 C.F.R. § 232.1(l), which prohibits the storage and carriage of firearms on USPS property. The district court decision found that the law was unconstitutional as applied to its prohibition on guns in parking lots, but not the ban on carry inside government buildings. Circuit Judge David M. Ebel–another Ronald Reagan appointee to decide against gun rights–was joined by Circuit Judge Gregory A. Phillips (appointed by Barack Obama) in the decision: We….conclude that the regulation is constitutional as to all USPS property at issue in this case, including the Avon Post Office parking lot, because the Second Amendment right to bear arms has not been extended to “government buildings.” Government buildings, in this context, includes the government owned parking lot connected to the U.S. Post Office. Alternatively, even if we were to conclude that the parking lot did not qualify as a “government building,” we would uphold this regulation as constitutional as applied to the parking lot under independent intermediate scrutiny. Ignoring McDonald’s command that the Second Amendment does not protect “second-class” rights, the Tenth Circuit held that “the risk inherent in firearms and other weapons distinguishes the Second Amendment right from other fundamental rights that have been held to be evaluated under a strict scrutiny test, such as the right to marry and the right to be free from viewpoint discrimination, which can be exercised without creating a direct risk to others.” Help us FIGHT President Obama’s push for more gun control! But the Supreme Court expressly rejected that argument in 2010 when it struck down the City of Chicago’s handgun ban. Justice Alito, writing for the majority, said: The right to keep and bear arms, however, is not the only constitutional right that has controversial public safety implications. All of the constitutional provisions that impose restrictions on law enforcement and on the prosecution of crimes fall into the same category. See, e.g., Hudson v. Michigan, 547 U.S. 586, 591, 126 S.Ct. 2159, 165 L.Ed.2d 56 (2006) (“The exclusionary rule generates `substantial social costs,’ United States v. "When things start to get a little bit hairy, I'll probably put on some headphones and listen to some music," he said. That's the cruel irony for someone suffering from post-traumatic stress: the day we celebrate our freedom is a nightmare for Cook and other combat veterans like him. "It brings back some of the -- what I like to call -- the parts of hell for me, things I don't really like to remember but I tend to think about each day because it's hard to keep them suppressed," Cook told FOX 13. During Cook's nine years in the Army, his unit was attacked more times than he can remember. They were also hit by four separate roadside bombs. The first one, in 2004, could have killed him. "There was an explosion, maybe five, ten feet from me," he said. "It was a well-coordinated attack by the enemy and I think we were really lucky to get out of there." Cook's said his experiences include "seeing things that I don't wish anyone else to see." Some of his worst memories flood back when he hears the explosions of fireworks during Independence Day and the days surrounding it. "They just fire off fireworks at all times during the day and night, so it's just for that week and week after, it is hell for me," he said. Cook is trying to make his community aware.

Pope Francis spoke during the same address about the failure of world powers to stop the Nazis during the Holocaust, asking why bombs weren’t used to halt transports to concentration camps. “The great powers had photographs of the railway routes that the trains took to the concentration camps, like Auschwitz, to kill the Jews, and also the Christians, and also the Roma, also the homosexuals,” Pope Francis said, according to the Independent. ”Tell me, why didn’t they bomb [those railroads]?” As TheBlaze previously reported, these remarks follow the pontiff’s comments about climate change, which place the bulk of the blame on human activity." They told us this afternoon it's important for them to have this event, even though it's against the law. The Washington state constitution says the right to bear arms shall not be impaired and impaired means to diminish and to reduce in any way. And we view 594, the passage of that and the result of Washington code as an impairment of the right to keeping bear arms. In the fact that it impairs our ability to buy and sell fire arms." Said Sam Wilson of Liberty for All. For a small fee, you can camp on site for the whole weekend at the Yakima arms expo. In addition to live music, food, and seminars, there's a few speakers scheduled to appear. One of those speakers told us, they're not going to comply with I-594 "We've always been forbearing in this. They passed a law and we backed up. Grudgingly, but we backed up. What we're saying here today is, we're done backing up, deal with it!" Says Mike Vanderboegh. As controversial as this topic may be, Sam Wilson wants the skeptics to know that this event isn't meant to be taken as a threat. "Really, the one thing we've stressed all along is that this is peaceful. This is not any kind of threat or violence. This is a peaceful exercise of constitutional rights"

The sickeningly predictable behavior by the big government progressives in the wake of the Charleston atrocity casts an even harder spotlight on the fact that we are in a struggle for the future of this nation. Forces are organized to promote and ensure the disarmament, victimization, and eventually conscript servitude of the good people of the United States of America. Nanny Bloomberg’s propaganda machine is in high gear and this time they are churning out disarmament lies using supposed religious leaders. This is something we will not tolerate or sit idly by and allow to go unanswered. A witness told the Wiener Zeitung newspaper that dead bodies were left lying face down in the road after the vehicle sped through streets near the the historical Herrengasse in Graz. The killing only stopped when the driver parked his battered car outside a police station. More than 30 pedestrians, including three children, were hurt at several locations during the rampage and 10 victims were in hospital with serious injuries. One patient was in a critical condition on Saturday afternoon. The driver, identified by police as a 26-year-old Austrian man of Bosnian heritage, has been arrested. He works as a professional driver and is married with two children. Police are not currently investigating terrorism as a motive and the suspect is believed to be suffering from mental illness. Witnesses recounted how the man drove his vehicle into crowds apparently at random, sending pedestrians and cyclists crashing into the windscreen and rolling over the bonnet. Dr Sea Rotmann, who was nearby, told Sky News: "I had a friend who was there and she saw people flying through the air. She saw bodies lying there, it was absolute chaos and mayhem. "Apparently the guy was attacking two elderly people with a knife and then attacking police with a knife when he got out." Police said the stabbing happened outside a grocery shop, where a man was seriously injured and a woman wounded less severely. The incident started at around 12.15pm local time (11.15am BST), sending screaming shoppers running into shops for safety. A statement from the city council said: "At 12pm there was an appalling incident in the centre of Graz, which has caused major alarm and left the city deeply shaken. "A killer used his car as a weapon and deliberately ran people down on a rampage. The perpetrator is in custody." A spokesperson said the killing spree started in Zweiglgasse, where one person died, and the driver continued through the city and over the Schönaugasse bridge to Herrengasse, ploughing into a cafe seating area in the Hauptplatz (main square). A witness speaking to the Wiener Zeitung compared the sound of chairs and tables being knocked over by the speeding car to a "gunfight". The mayor of Graz, Siegfried Nagl, was riding his Vespa only metres away from the car as it screamed down Zweiglgasse and said he heard a "loud bang" behind him. He described seeing the vehicle overtake a bus at "extremely high speed" and hit a man, who died at the scene. Mr Nagl said: "At first I thought it was an accident and the driver would stop, but he carried on purposefully and had deliberately killed the man." The suspect was caught in a nearby Schmiedgasse, where he stopped his car outside a police station. Josef Klamminger, the director of police, said the driver's motive was not yet known but he appeared to be "psychotic" following problems at home.

Another accidentally fired a bullet in a restroom stall. A third deputy stumbled over a stroller in a closet as he was searching for a suspect, squeezing off a round that went through a wall and lodged in a piece of furniture in the next room. Accidental gunshots by Los Angeles County sheriff's deputies have more than doubled in two years, endangering bystanders and occasionally injuring deputies. The jump coincides with the department's move to a new handgun that lacks a safety lever and requires less pressure to pull the trigger. Sheriff's officials say that the increase in accidental discharges — from 12 in 2012 to 30 last year — occurred because deputies were adjusting to the new gun. They expect the numbers to fall in the years ahead. So far this year, the department has recorded seven accidental discharges, five of which involved the new weapon. But the problems may not be over, as more deputies switch to the Smith & Wesson M&P9. In response, department officials have imposed extra training requirements. The M&P has obvious benefits. More recruits — including more women — are now passing the firearms test, and veteran deputies are also logging better scores at the firing range. But the sharp increase in accidental discharges has prompted an investigation by the Sheriff's Department's new inspector general. Critics say this type of semiautomatic, which is widespread in law enforcement and includes the Glock used by many agencies, is too easy to misfire. At the New York Police Department, a rookie officer is facing criminal charges, including negligent homicide, in a fatal shooting in a housing project stairwell. An attorney for the officer says he accidentally fired his department-issued Glock. A former Los Angeles Police Department officer who was paralyzed when his 3-year-old son shot him with a Glock has sued the gun manufacturer and others, alleging that the light trigger pull and lack of a safety mechanism contributed to the accident. Bob Owens, editor of BearingArms.com, says the design of the Glock and the M&P makes such tragedies more likely. "I don't think, with the amount of training most agencies have, that a gun that has so few tolerances for mistakes is the best choice," he said. An adjustment For two decades, L.A. County sheriff's deputies carried the Beretta 92F, a heavy metal gun with a large grip. If you still have your finger on the trigger when you put it in your holster, you'll end up with a stripe on your leg. - Richard Fairburn, a firearms expert. People with small hands often have trouble flipping up the Beretta's safety as they prepare to fire. The first shot requires 12 to 15 pounds of pressure on the trigger, forcing some to use two fingers and reducing shooting accuracy for many.

About the Host Paul G. Markel has worn many hats during his lifetime. He has been a United States Marine, police officer, professional bodyguard, and small arms and tactics instructor. Markel has been writing professionally for law enforcement and firearms periodicals for nearly 20 years, and has hundreds of articles in print. A regular guest on nationally syndicated radio talk shows, Markel is a subject matter expert in firearms training and use of force. Markel has been teaching safe and effective firearms handling to students, young and old, for decades and has also worked actively with 4H Shooting Sports programs. Markel holds numerous instructor certifications in multiple disciplines; nonetheless, he is, and will remain a dedicated Student of the Gun. About the Co-Host Not just another pretty face, Jarrad Markel has experience and training beyond his years. Jarrad has been training to be a fighter since elementary school when he first learned the art of collegiate wrestling. Now skilled in Jujitsu, Judo, Muay Thai, Sambo, the Way of the Fighting Pistol and Fighting Rifle, Jarrad is a well-rounded, tactical athlete with several professional MMA fights under his belt. More than a brute, Jarrad has brains as well. He is the lead editor and videographer for Student of the Gun and works directly for Think On! Productions creating a wide variety of video material.
