Judge C. Hellums of Paris, Miss.; and Pvt. Donald D. Owens of Cleveland will be buried in a single casket, officials said. The soldiers, assigned to the 773rd Tank Battalion, were fighting their way east to France’s eastern border in fall 1944, clearing German forces out of Parroy Forest near Lunéville. The men were presumed dead after their M10 Tank Destroyer was attacked by enemy forces in October 1944. Two soldiers survived the attack, and DoD says evidence then indicated the soldiers’ remains were destroyed. The tenth 10th Amendment limits the powers of the federal government to those delegated to it by the Constitution. One of the theoretical pillars of the United States Constitution is the idea of "checks and balances" among the powers and responsibilities of the three branches of American government: the executive, the legislative and the judiciary. For example, while the Congress (legislative) has the power to create law, the executive (President) can veto any legislation -- an act which, in turn, can be overridden by Congress.
